Welcome to CK Cases, a multi-tenant legal case management and judicial workspace platform developed, hosted, and maintained by ITPlace Nigeria Ltd ("Company", "We", "Our", or "Us"). By accessing, subscribing to, or utilizing our software, web applications, APIs, or mobile recording tools, you ("User", "Firm", "Judge", or "Subscriber") agree to be bound by these Terms and Conditions. If you do not agree, do not use the platform.

1. Acceptance of Terms & Capacity

By registering an account, provisioning a tenant workspace, or logging into CK Cases, you represent that you are a legal practitioner, accredited judicial officer, authorized firm administrator, or corporate entity acting with full legal capacity under the laws of the Federal Republic of Nigeria.

2. Software-as-a-Service (SaaS) License & Scope

ITPlace Nigeria Ltd grants you a limited, non-exclusive, non-transferable, revocable license to access and use CK Cases strictly for lawful legal practice, court proceeding management, and internal firm administrative operations, subject to your active subscription plan and seat limitations.

3. User Data, Privacy & Compliance

• Data Ownership: Users and law firms retain full ownership of client data, case files, and uploaded documents input into their respective isolated tenant database.
• Data Processing Consent: You grant ITPlace Nigeria Ltd the right to store, process, back up, and transmit data strictly as necessary to provide cloud hosting, database administration, and software features.
• Compliance with Regulations: You warrant that all personal data, client information, and case files uploaded by your firm comply with the Nigeria Data Protection Act (NDPA) and applicable privacy regulations. ITPlace Nigeria Ltd acts solely as a software technology provider and data processor.

4. AI Features & Judicial Tools Disclaimer

CK Cases incorporates artificial intelligence models (such as automated transcription engines, speech-to-text audio converters, and AI judgment draft assistants):

• No Legal or Judicial Guarantee: AI-generated summaries, transcript segments, and draft judgments are provided strictly as administrative support tools. They do not constitute formal legal advice, binding judicial rulings, or infallible transcripts.
• Human Review Mandatory: Judges, lawyers, and firm administrators are solely responsible for reviewing, verifying, editing, and authorizing all transcripts, court records, and documents generated through the platform. ITPlace Nigeria Ltd accepts no liability for errors, hallucinations, or omissions in AI processing.

5. Limitation of Liability & Exclusion of Damages

To the maximum extent permitted by applicable Nigerian law, ITPlace Nigeria Ltd, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data corruption, loss of court filing deadlines, or business interruption arising out of or related to your use of CK Cases.

The cumulative aggregate liability of ITPlace Nigeria Ltd for any direct claims under these terms shall be strictly limited to the total subscription fees paid by you to ITPlace Nigeria Ltd in the preceding twelve (12) months.

6. Indemnification

You agree to defend, indemnify, and hold harmless ITPlace Nigeria Ltd and its officers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms and Conditions;
• Any misuse of client data, privacy breaches, or unauthorized uploads by your firm's users;
• Frivolous claims, disputes between firm members, or regulatory penalties incurred due to user negligence.

7. Service Availability & Subscriptions

Access to CK Cases is contingent upon active subscription payments managed via integrated payment gateways. ITPlace Nigeria Ltd reserves the right to suspend or terminate tenant access upon subscription expiration or seat capacity violations. We do not guarantee uninterrupted, error-free server uptime, though reasonable commercial efforts are maintained.

8. Password Security and Account Integrity Policy

Each subscription seat is licensed strictly for individual use by a single authorized person. Sharing account credentials, passwords, or granting access to unauthorized individuals outside your designated team seats is strictly prohibited. We continuously monitor concurrent login anomalies, session overrides, and device fingerprints. CK Cases reserves the right to immediately suspend, terminate, or cancel any user account or tenant subscription without prior notice if investigation or automated telemetry indicates password sharing or unauthorized multi-party access.

8. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising under these terms shall be resolved through binding arbitration in Abuja, Nigeria, in accordance with the Arbitration and Mediation Act.
